Welcome to BREAKBEAT LAB The terms "we," "us," and "our" refer to BREAKBEAT LAB. BREAKBEAT LAB operates this store and website, including all related information, content, features, tools, products, and order services (collectively, the "Service"), to provide you, the customer, with a curated shopping experience. BREAKBEAT LAB is powered by Shopify, which enables us to provide the Service to you.

The following Terms of Service, together with any policies referenced herein (collectively, the "Terms of Service" or "Terms"), describe your rights and responsibilities when using the Service.  

Please read these Terms of Service carefully, as they contain important information regarding your legal rights, covering areas such as disclaimers of warranties and limitations of liability.  

By visiting, accessing, or using our Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, please do not use or access our Service.

Agreement to Terms
By using our store, you are deemed to have given your valid and irrevocable consent to these Terms. Customers who do not agree to these Terms may not use our store.

User Registration
Those who wish to use our store may apply for user registration in accordance with the procedures defined by our store, subject to agreeing to these Terms, and registration shall be complete upon our approval.

Refusal of Registration
Our store reserves the right to decline an application for user registration if we determine that any of the following grounds apply. We have no obligation to disclose the reasons for such refusal:

False information was submitted during application.

The applicant has previously violated these Terms.

Any other circumstances where our store deems registration to be inappropriate.

Use by Minors
If you are a minor, please use our store only with the consent of a legal representative (such as a parent or guardian). If a customer who started using our store without legal representative consent reaches the age of majority, all actions taken while a minor shall be deemed ratified.

Management of Login Credentials
Customers are solely responsible for properly managing their login credentials. Under no circumstances may login credentials be transferred, lent, or shared with any third party. Our store shall not be held liable for any damages arising from the unauthorized use of login credentials by a third party, except in cases of intentional misconduct or gross negligence by our store.

Orders
When you place an order, your submission constitutes an offer to purchase products under these Terms. Contract acceptance by our store occurs only when a notification email or other communication confirming shipment is dispatched to you.

Order Cancellations
We do not accept order cancellations for customer convenience once an order has been placed.

Termination Due to Breach
Our store may terminate sales contracts with you without prior notice if any of the following apply. In such cases, our store incurs no liability for damages:

You violate or are suspected of violating any provision of these Terms.

You are a past violator or affiliated with a past violator of these Terms.

Any other situation where our store determines that the relationship of trust with you has been compromised.

Refusal of Delivery and Failure to Receive
If you refuse delivery, if the shipping address is unknown, or if delivery cannot be completed due to customer convenience, our store incurs operational damages including round-trip shipping fees, cash-on-delivery handling fees, return administration fees, storage fees, reshipment costs, content-certified mail and communication expenses, packaging costs, and labor expenses incurred for shipping and processing. Our store reserves the right to claim compensation for these costs.

If the retention period below expires after a delivery attempt without receipt, the sales contract shall be deemed terminated due to customer convenience. In this event, our store shall be released from delivery obligations, and you shall immediately pay a penalty equivalent to the product purchase price in addition to the damages mentioned above:

Storage Retention Period: 7 days

Returns and Exchanges
Returns or exchanges for customer convenience are not accepted. However, if a product is acknowledged to be defective, we will accept returns or exchanges only if you email us at our designated address within 7 days (starting the day after receipt) with detailed reasons explaining the defect, and such email reaches us within this timeframe. Returns or exchanges requested after this period will not be accepted for any reason.

Other Transaction Rules
In addition to the clauses covering Orders, Cancellations, Termination, Delivery Refusal, and Returns/Exchanges, details regarding payment methods, transfer of title, shipping, and specific operational terms are governed by our Legal Notice (Specified Commercial Transactions Act) and other policies set forth separately.

Reward Points
Our store may issue store-specific reward points. Details regarding reward points shall be governed by separate rules established in designated sections of our store.

Late Payment Penalties
If a customer defaults on a monetary obligation owed to our store, late payment charges shall accrue at a rate of 14.6% per annum until full payment is settled.

User Submissions and Submissions Rules
You represent and warrant that you possess all lawful rights to submit content or information and that your submissions do not infringe upon any third party’s intellectual property rights (including copyrights, patents, utility models, trademarks, designs, and related application rights, ideas, or know-how), proprietary rights, or other rights.

You retain copyright ownership of your submissions. Our store does not acquire copyright ownership. However, you grant our store a royalty-free, perpetual, worldwide, non-exclusive license to copy, adapt, publicly transmit, and make available your submissions to the extent necessary for operating, maintaining, improving, or promoting the Service. You agree not to exercise moral rights against our store or our successors and licensees.

You are responsible for backing up your own submissions; our store has no backup obligations. You must not submit information that:

Infringes upon intellectual property, privacy, publicity, honor, or other rights of our store or third parties.

Contains personally identifiable information (except when requested for user registration or authorized by us).

Contains obscene expressions.

Is intended for meeting strangers of any gender or soliciting obscene behavior.

Promotes, induces, or encourages suicide or self-harm.

Relates to drug trafficking or encourages illicit drug use.

Promotes religious activities, religious groups, political campaigns, or political organizations.

Relates to multi-level marketing or network business solicitations.

Constitutes junk mail or spam messages.

May adversely affect minors.

Contains cruel, violent, or offensive language/content.

Contains computer viruses or malicious programs.

Is otherwise deemed inappropriate by our store.

Prohibited Conduct
When using our store, you must not engage in any of the following activities:

Violating laws, court judgments, orders, or legally binding administrative measures, or encouraging such violations.

Criminal acts or activities linked to criminal conduct.

Infringing upon intellectual property rights of our store or third parties.

Infringing upon privacy, publicity, honor, or other rights of our store or third parties.

Overloading servers or network infrastructure, or interfering with normal operations.

Actions that disrupt or risk disrupting the operation of our Service.

Unauthorized access or attempting unauthorized access.

Disassembling, decompiling, reverse engineering, or analyzing source code.

Unlawfully accessing connected systems, or rewriting or deleting stored data.

Copying, transmitting, transferring, renting, or altering store software or website assets.

Monetizing, renting, selling, or transferring store accounts or content to third parties.

Commercially exploiting information obtained from our store.

Seeking unauthorized financial gain through unintended operational methods.

Conducting unauthorized advertising, promotion, solicitation, or business activities.

Collecting or storing personal data of other users.

Utilizing our store for illegal, fraudulent, or improper purposes.

Causing disadvantage, harm, or discomfort to other users or third parties.

Impersonating other individuals or entities.

Using another customer's account.

Seeking unacquainted romantic or personal encounters.

Providing direct or indirect benefits to Anti-Social Forces.

Violating public order and morals.

Using our store while walking, driving, or in other unsafe circumstances.

Exclusion of Anti-Social Forces
You represent and warrant that you (and your officers, if a corporate entity) do not and will not fall under any of the following categories:

Organized crime groups, group members, former members (within 5 years of leaving), associate members, affiliated companies, corporate racketeers, social movement activity fronts, specialized violent groups, or other equivalent entities (collectively, "Organized Crime Group Members").

Having management controlled by Organized Crime Group Members.

Having Organized Crime Group Members substantially involved in management.

Utilizing Organized Crime Group Members for improper gain or to inflict damage on third parties.

Providing funds, facilities, or conveniences to Organized Crime Group Members.

Officers or key personnel maintaining socially unacceptable relationships with Organized Crime Group Members.

You further guarantee that you will not, directly or through third parties, engage in violent demands, unreasonable requests exceeding legal obligations, threatening behavior, physical violence, or spreading false rumors/deceitful means to damage our store’s reputation or interfere with operations.

Service Restrictions and Account Cancellation
Our store reserves the right, without prior notice, to restrict your access to all or part of our Service, or cancel your user registration, if:

You breach any provision of these Terms.

Registration details contain false statements.

You default on financial obligations.

There is no response to communications from us within a reasonable timeframe.

The account remains inactive for a prolonged period.

You are determined to be affiliated with Anti-Social Forces.

Our store otherwise determines that continued use is inappropriate.

We accept no liability for any loss or damage resulting from actions taken under this clause.

Suspension of Service
Our store may suspend or interrupt the Service without prior notice if:

System maintenance or updates are required.

Delivery becomes impossible due to force majeure, including earthquakes, lightning, fire, power outages, natural disasters, or epidemics.

Computer or communication networks fail due to accidents.

Delivery is otherwise deemed unfeasible by our store.

We accept no liability for any loss or damage incurred by users or third parties due to Service suspension.

Account Cancellation / Withdrawal
Customers may cancel their registration and withdraw from our store at any time according to prescribed procedures.

Disclaimer of Warranties
Our store makes no warranty that site content is free of system errors, bugs, or third-party infringement, nor do we guarantee safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose.

Limitation of Liability
Our store shall not be liable for any damages incurred in connection with your use of our store. However, if the contract between you and our store constitutes a consumer contract under the Consumer Contract Act of Japan, this total disclaimer shall not apply. In such cases, our store shall be liable only for direct and actual damages caused by our negligence (excluding gross negligence), capped at the purchase amount of the product directly related to the damage.

Changes to Services
Our store reserves the right to modify, suspend, or terminate the Service at any time without notice, and assumes no liability for damages resulting from such changes.

Modifications to Terms of Service
Our store may update these Terms at any time without prior notice. Revised Terms take effect upon being posted on our website. Continued use of our store after changes are posted constitutes acceptance of the updated Terms.

Handling of Personal Data
Personal information collected through your use of our store shall be handled appropriately in accordance with our Privacy Policy.

Communications between you and our store shall be conducted via methods designated by us. Unless you notify us of contact detail changes through our designated procedure, notifications sent to your registered address shall be deemed delivered upon dispatch.

Business Transfer
If our store transfers its business to another company (via business sale, company split, or other transfer methods), contractual status, rights, obligations, and user information under these Terms may be transferred to the transferee. You hereby consent in advance to any such transfer.

Severability
If any provision or portion of these Terms is held invalid or unenforceable, such determination shall not affect the validity of remaining provisions, which shall remain in full force and effect.

Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan.

Jurisdiction
In the event of any legal dispute arising from or related to the use of our store, the Nagoya District Court shall have exclusive primary jurisdiction.
